Anchorpoint Property Group reserves the right, at its discretion, to revise the terms of this Agreement and to change, suspend, discontinue, or modify any aspect of any website. Your continued use after revisions are posted constitutes acceptance of those revisions.

1. Certification of user

By using or attempting to use this website, you certify that you are a resident of the United States or otherwise authorized to conduct business in the United States, are at least 18 years of age, and have the legal capacity to enter into this Agreement.

2. Content and registration

“Information” means all areas and aspects of the website and services including text, data, photos, graphics, and video, and any information obtained through the website, Anchorpoint Property Group computers or network, or any subscription, software, product, or service provided by Anchorpoint Property Group.

2.2 Vendor content

We may link to or display information, advertisements, discounts, products, or services offered by vendors. We do not guarantee the availability or accuracy of vendor content or offers, and do not endorse, guarantee, or insure any vendor products or services.

2.3 External sites and vendors

Anchorpoint Property Group shall not be held liable, directly or indirectly, for any loss or damage caused by your use of an external site linked to the service, vendor content, or vendor products or services. Statements on the websites concerning our products or services do not constitute an offer, but are solicitations of an offer.

2.4 Registration

You may browse certain content without registering. To use certain other aspects you may be required to register and select a user ID and password. You agree to keep that information confidential, to be the sole user of the registration, and to use it solely to access the website and obtain services. If you believe your registration has been compromised, change it promptly and notify us immediately.

No portion may be copied, published, reproduced, modified, performed, displayed, sold, transmitted, broadcast, rewritten, or redistributed in any medium. This prohibition includes screen scraping and database scraping. You may download or print one copy of pages strictly for personal, non-commercial use, provided any printout includes our copyright notice. Our logos, page headers, custom graphics, buttons, and icons are service marks, trademarks, or trade dress of Anchorpoint Property Group. All other product names and company logos are trademarks of their respective owners.

3.2 Notice of copyright infringement

We respect the copyrights of others and may terminate your license to use the services for infringing activity. If you believe your copyrighted work has been reproduced on the website in a way that constitutes infringement, contact us at 832-979-0207.

3.3 Restricted use

You agree to use the website and information for lawful purposes only, and not to post or transmit content that infringes others’ rights, is unlawful or otherwise objectionable, or is protected by intellectual property rights without authorization. 3.5 Public messages

All electronic forums made available to users are the sole property of Anchorpoint Property Group and are not a public forum. Information posted by users other than us is the sole responsibility of the originator. You agree not to use the service to:

• interfere with or disrupt the service or networks;
• violate any applicable law or regulation;
• stalk or harass another; or
• collect or store personal data about other users.

3.6 Linking

Without prior written consent, you may not use our proprietary logos, marks, or other distinctive materials in links, and you may not link to, deep-link, or frame the website in any manner likely to imply affiliation or endorsement, cause confusion, dilute trademarks, violate law, or disparage Anchorpoint Property Group.

4. Access and delays in services

Anchorpoint Property Group, its affiliates, subsidiaries, and vendors have no responsibility to provide you access to the website and are not liable for any loss or liability resulting from delays, inaccuracies, errors, omissions, or interruptions for any reason, including equipment failures, connectivity issues, defects, weather, labor actions, acts of God, riots, armed conflicts, acts of war, acts of terrorism, or like causes.

5. Monitoring

Anchorpoint Property Group reserves the right to monitor content transmitted or received through the service. Information may be examined, recorded, copied, and used for authorized purposes. Use of the service constitutes consent to such monitoring.

6. Representations, warranties, and limitation of liability

6.1 General disclaimer and limited warranty

Certain aspects of the information, vendor content, and links are compiled from sources beyond our control and may contain inaccuracies. The website is provided on an “AS IS, WITH ALL FAULTS” basis. Anchorpoint Property Group and its licensors and vendors expressly disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.

6.2 Data risk

You assume all risk of errors or omissions in the website, including in the transmission or translation of data, and are responsible for procedures and safeguards suitable for your needs.

6.3 Viruses

While we use reasonable efforts to prevent viruses or similar programs from operating on or passing through the website, you assume responsibility for detecting and removing any such threats.

6.4 Limitation of liability

Anchorpoint Property Group and its affiliates, subsidiaries, and vendors are not liable for any special, incidental, or consequential damages arising out of the use or inability to use the service. If the above limitations fail of their essential purpose, liability is limited to the greater of $100.00 or ten percent (10%) of the sums paid to Anchorpoint Property Group by you under this Agreement, as liquidated damages. These provisions survive termination.

6.5 FTC notice

Some states do not allow limitations on implied warranties or the exclusion or limitation of incidental or consequential damages, so the above may not apply to you. You may have other rights which vary by state.

7. Indemnification

You shall release, discharge, defend, indemnify, and hold harmless Anchorpoint Property Group and its affiliates, subsidiaries, vendors, and their respective owners, directors, employees, agents, representatives, and contractors from and against all losses, claims, demands, and causes of action, including costs and attorneys’ fees, arising from or relating to your access and use of the website. These obligations apply even if caused in whole or in part by the negligence or other fault of any person or entity, including the indemnitees.

8. Privacy policy

These Terms of Use incorporate our Privacy Policy, which is fully incorporated herein.

9. Unsolicited marketing

Anchorpoint Property Group supports responsible e-commerce and does not authorize anyone to use the service to broadcast or transmit unsolicited commercial, non-commercial, bulk, or junk email. We do not forward names and addresses to third parties for their own marketing. Users may opt out using the option in each email, or by contacting us at 832-979-0207, which is also how to report spam or threatening messages. We may take legal or technical steps to prevent spam and may suspend or terminate access for violations.

10. Miscellaneous

10.1 Governing law, limitations, and venue

The laws of the State of Texas, without regard to conflicts of law, govern this Agreement. Any claims arising from or relating to your access and use of the service must be instituted within two (2) years from the date the claim arose and shall be brought exclusively in the state or federal courts located in Dallas County, Texas.

10.2 Assignments

You may not assign any rights, obligations, privileges, or performance hereunder without our prior written consent. Any unauthorized assignment is null and void.

10.3 Severability

If any provision is found unlawful or unenforceable, the court shall reform it to render it enforceable, or delete it if reformation is not possible; as modified, this Agreement remains fully enforceable.

10.4 Connectivity charges

You are responsible for any third-party connectivity charges incurred by your access to the website and use of the services, including text messaging and data fees.

10.5 Termination

Anchorpoint Property Group may terminate or suspend your use of the website for any reason. Upon termination, all rights granted to you terminate and revert to Anchorpoint Property Group.

10.6 Notice

10.7 California users

Pursuant to California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Sacramento, CA 95834, or by telephone at 916-445-1254 or 800-952-5210.

10.8 Entire agreement

This Agreement is complete and effective at the time you begin use of the service and constitutes the entire agreement between the parties. In the event of inconsistencies between this Agreement and any future published terms, the last published Agreement controls. Any rights not expressly granted are reserved by Anchorpoint Property Group.
